Grover Beach man charged with secretly recording women at local gym

– The San Luis Obispo County District Attorney’s Office has filed charges and obtained an arrest warrant for a Grover Beach man accused of secretly recording multiple women inside tanning booths at a fitness center in Arroyo Grande.
Kyle L. Combs, 40, of Grover Beach, has been charged with 12 misdemeanor counts of invasion of privacy in violation of California Penal Code section 647(j)(1), according to the District Attorney’s Office.
The criminal complaint alleges Combs secretly used a device to view or record women while they were nude inside standing tanning booths at Planet Fitness in Arroyo Grande, where they had a reasonable expectation of privacy. The alleged offenses occurred between July 12 and Dec. 29 and involve 12 separate Jane Doe victims.
According to prosecutors, investigators found evidence of additional incidents involving the same alleged conduct at the same location between January and June. Those incidents were outside the statute of limitations and could not be charged.
The case stems from an investigation by the Arroyo Grande Police Department. Investigators are continuing to determine whether additional victims were targeted.
Under California law, Penal Code section 647(j)(1) prohibits using a device to look into or otherwise view a private area, including a dressing room or tanning booth, with the intent to invade another person’s privacy. Because the complaint alleges adult victims and does not allege a qualifying prior conviction, the offenses can only be charged as misdemeanors under current state law.
“Secretly recording women while they are nude inside tanning booths is a deeply disturbing violation of privacy, dignity, and personal security,” District Attorney Dan Dow said. “People using a gym or fitness center should never have to fear that they are being watched or recorded in one of their most private moments. Our office will continue to work with law enforcement to hold offenders accountable and to seek justice for every victim.”
The District Attorney’s Office noted that California law generally limits allegations involving secretly recording multiple nude victims in private tanning booths to misdemeanor charges unless additional circumstances exist. The office stated that any change to make such conduct punishable as a felony would require action by the California Legislature.

Superior Court Judge Erin Childs signed the arrest warrant and set bail at $50,000.
As with all criminal cases, the charges are allegations, and Combs is presumed innocent unless and until proven guilty beyond a reasonable doubt.
