Atascadero adopts law holding social hosts liable for fireworks
‘Illegal fireworks put our entire community at risk,’ says police chief
– The Atascadero City Council unanimously adopted a new Fireworks Social Host Ordinance on Dec. 9 to address illegal fireworks and public safety concerns, according to city officials.
The ordinance took effect immediately and establishes liability for individuals who own, control, or host gatherings on a property where illegal fireworks are discharged on or adjacent to that property.
City officials said illegal fireworks have remained a concern in Atascadero, particularly during Independence Day and New Year’s Eve, citing fire danger, disturbances to residents and animals, and impacts on emergency response services.
Under the ordinance, each violation may result in a $1,000 administrative fine, with a maximum penalty of $10,000 per day. Violations may also be prosecuted as misdemeanors when appropriate. The city may recover costs associated with emergency responses, including personnel time, equipment damage, and medical expenses for injured responders.
Police Chief Dan Suttles said the ordinance provides a more effective enforcement tool. “Illegal fireworks put our entire community at risk,” Suttles said. “This ordinance gives us a more practical and enforceable way to hold people accountable and to keep our neighborhoods safe. Our goal is to prevent fires, prevent injuries, and give residents some peace during the holidays.”
City officials said all fireworks, including those marketed as “Safe and Sane,” remain prohibited within Atascadero city limits. The ordinance applies to property owners, renters, and anyone hosting or controlling a gathering, and social hosts may be held responsible even if they did not personally set off fireworks.
Officials said reasonable preventative steps, such as informing guests and reporting violations, may help avoid liability. Residents are encouraged to report illegal fireworks and are not expected to confront violators.
The city plans to launch an education and outreach effort to inform residents about the ordinance, the risks associated with illegal fireworks, and ways community members can help reduce violations. The effort will include website updates, social media posts, a press release, and community presentations.
Residents can report illegal fireworks by calling the Atascadero Police Department non-emergency line at (805) 461-5051. Emergencies, including active fires, should be reported by calling 9-1-1.
